Use of the site

Eligibility and access

By accessing or using tcgame.com.co (the "Site"), you confirm that you are at least 18 years of age, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into a binding agreement under the Indian Contract Act, 1872. If you do not meet these requirements, you must not use the Site. TC Game reserves the right to verify your eligibility at any time and to restrict access where eligibility cannot be confirmed.

Permitted use

You may access and browse the Site solely for your personal, non-commercial use. You agree not to reproduce, distribute, or publicly display any part of the Site without prior written permission from TC Game; use automated tools, bots, or scrapers to collect data; attempt to gain unauthorised access to any portion of the Site or its related systems; transmit viruses or other harmful code; or engage in any activity that disrupts the proper functioning of the Site.

Any use of the Site for fraudulent purposes, including misrepresenting your identity or manipulating in-game outcomes, constitutes a material breach of these Terms and may be reported to the relevant Indian law enforcement authorities.

Account responsibility

If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify TC Game immediately if you suspect any unauthorised use. TC Game reserves the right to suspend or terminate accounts found to be in breach of these Terms, including accounts associated with multiple registrations, fraudulent payment activity via platforms such as PhonePe, GPay, or BHIM UPI, or any attempt to circumvent geographic or age restrictions.

Intellectual property

Ownership

All content on the Site, including text, graphics, logos, images, audio, video, software, and the overall compilation thereof (collectively, "Content"), is the exclusive property of TC Game or its licensors and is protected under the Copyright Act, 1957 (India) and applicable international intellectual property conventions, including the Berne Convention. Unauthorised reproduction or distribution of Content may expose you to civil and criminal liability under Indian law.

Limited licence

TC Game grants you a limited, non-exclusive, non-transferable, revocable licence to access and view the Content solely for personal, non-commercial purposes. This licence does not include the right to copy, create derivative works, sell or commercially exploit the Content in any form, remove proprietary notices, or frame or mirror the Site on any other website without TC Game's prior written consent. Any rights not expressly granted herein are reserved by TC Game.

Trademarks and user content

The name "TC Game," the TC Game logo, and all related marks are trademarks of TC Game. Nothing on the Site grants you any licence to use these marks without prior written authorisation. If you submit content to the Site, such as reviews or feedback, you grant TC Game a worldwide, royalty-free, perpetual licence to use, reproduce, and distribute that content for any lawful purpose. You represent that such content does not infringe the rights of any third party.

Limitation of liability

Disclaimer of warranties

The Site and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. TC Game does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site is entirely at your own risk.

Cap on liability

To the maximum extent permitted by applicable law, including the Information Technology Act, 2000 (India), TC Game and its officers, directors, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site. This includes loss of data, loss of profits, or damages resulting from payment failures processed through third-party platforms including PhonePe, GPay, or BHIM UPI.

Where liability cannot be fully excluded by law, TC Game's total aggregate liability shall not exceed INR 500 (five hundred rupees) or the amount you paid to TC Game in the preceding thirty days, whichever is greater.
